These Terms & Conditions (the “Terms”) apply to your access to and use of www.wishmascot.com and any order you place through the website (collectively, the “Site”). The Site is operated by Bestyork LLC through the Wishmascot brand (“Wishmascot,” “we,” “us,” or “our”).

Please read these Terms before using the Site or placing an order. By accessing the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

Nothing in these Terms limits any consumer right or remedy that cannot lawfully be excluded or limited.

1Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to place an order. If you are under 18, you may use the Site only with the involvement and supervision of a parent or legal guardian.

If you use the Site on behalf of a company, school, team, organization, or other entity, you represent that you are authorized to accept these Terms on its behalf.

2Accounts

You are responsible for providing accurate, current, and complete account information and for keeping your login credentials confidential. You are also responsible for activity conducted through your account, except to the extent caused by our failure to use reasonable security measures.

Please contact us promptly at sale@wishmascot.com if you believe your account has been accessed without authorization.

We may suspend or close an account when reasonably necessary to protect the Site, our customers, or third parties; to investigate suspected fraud or unlawful activity; or to address a material breach of these Terms. Where reasonably practicable, we will provide notice.

3Product Information

We work to present product descriptions, measurements, materials, colors, images, availability, and prices accurately. However:

  • colors may vary depending on screens, lighting, materials, and production batches;
  • dimensions and weights may be approximate;
  • handmade and made-to-order products may have minor, non-material variations; and
  • packaging, materials, features, or specifications may be updated where the change does not materially reduce the product’s quality or function.

Please review the product page, size chart, customization details, and your order confirmation carefully before approving or purchasing a product. If a product page conflicts with these Terms, the product-specific terms control only for that product and only to the extent of the conflict.

4Custom and Personalized Products

Many mascot costumes are made to order or customized. You are responsible for supplying complete and accurate measurements, colors, text, logos, artwork, delivery requirements, and other specifications.

If we provide a design proof or specification sheet for approval, production may not begin until we receive your approval. Once approved, changes may result in additional charges or a revised production schedule, and some changes may no longer be possible.

You represent that you own, or have all necessary rights and permissions to use, any name, logo, character, image, artwork, trademark, or other material you provide to us. You authorize us and our production partners to reproduce and adapt those materials only as reasonably necessary to prepare proofs, manufacture your product, fulfill your order, provide support, and meet legal or recordkeeping obligations.

We may decline or cancel a customization request that we reasonably believe is unlawful, unsafe, deceptive, offensive, or infringes another person’s rights. If we cancel for this reason before production begins, we will refund the amount paid for the affected item, except for any separately disclosed and already completed design work where permitted by law.

5Orders and Contract Formation

Submitting an order is an offer to purchase the products in your cart. An automated order acknowledgment confirms that we received your order; it does not necessarily mean that we have accepted it.

We may verify payment, shipping information, product availability, customization requirements, or suspected fraud before accepting an order. An order is accepted when we send an express acceptance or production confirmation, or when the order is shipped, whichever occurs first.

We may refuse or cancel an order before acceptance if, for example, a product is unavailable, information is incomplete, a price or description contains a material error, payment cannot be authorized, the order appears fraudulent or unlawful, or we cannot fulfill the requested customization. If we cancel an order after receiving payment, we will refund the amount paid for the canceled portion.

6Prices and Payment

Prices are displayed in the currency shown on the Site and may change before you place an order. The price charged is the price displayed at checkout, subject to correction of an obvious error.

You agree to provide valid and accurate billing information and authorize us and our payment providers to charge the total shown at checkout. Your bank or payment provider may charge currency conversion, cross-border, or other fees that we do not control.

If a product is listed at an obviously incorrect price or with materially incorrect information, we may cancel the affected order and issue a refund. We will not substitute a higher price without asking you to approve it.

7Order Changes and Cancellations

For standard, non-custom products, you may request cancellation before dispatch. We will make reasonable efforts to honor the request, but cancellation is not guaranteed once processing has begun.

Custom, personalized, or made-to-order products generally cannot be canceled after we have begun design, material preparation, or production. Any cancellation right, fee, or refund will depend on the stage of work completed and applicable law.

To request a cancellation or change, contact sale@wishmascot.com as soon as possible and include your order number. Additional details are available in our Order Cancellation Policy.

8Production, Shipping, and Delivery

Production and delivery dates are estimates, not guarantees, unless we expressly agree otherwise in writing. Customization, proof approval, order volume, carrier operations, customs review, weather, public holidays, and events outside our reasonable control may affect timing.

You are responsible for providing a complete and accurate delivery address and for reviewing it before submitting your order. Contact us promptly if a correction is needed. Address changes may not be possible after dispatch and may result in additional carrier charges.

When tracking shows a package as delivered but you cannot locate it, please check the delivery location, household or business recipients, neighbors where appropriate, and the carrier, then contact us promptly so we can assist with an investigation.

9Customs, Duties, and Import Taxes

Orders shipped internationally may be subject to customs duties, import taxes, VAT, brokerage fees, handling fees, or other charges imposed by the destination country, carrier, or local authority. Unless the checkout page expressly states that a charge is included and collected by us, the recipient is responsible for these amounts.

Customs authorities may open or inspect packages and may delay, hold, or refuse a shipment. We cannot control customs decisions or predict the amount of local charges. You are responsible for checking the import rules that apply at the destination before ordering.

We will describe goods and declare value accurately as required by law. We will not agree to falsify customs documents, understate value, or mark a commercial order as a gift.

If a shipment is refused, abandoned, or returned because duties or taxes were not paid, we may deduct from any refund the nonrecoverable shipping, return, storage, customs, or carrier charges, to the extent permitted by law. See our Customs & Import Tax Policy for additional information.

10Returns, Refunds, and Defective Products

Returns and refunds are governed by our Return Policy, which forms part of these Terms.

In general, eligible standard products must be returned in their original, unused condition within the period stated in the Return Policy. Custom, personalized, and made-to-order products are generally non-returnable unless they are defective, damaged on arrival, materially different from the approved specifications, or otherwise returnable under applicable law.

If an item arrives damaged, defective, or incorrect, contact sale@wishmascot.com within 7 days after delivery and include your order number, a description of the issue, and clear photos or video where reasonably necessary to assess the claim. This notice period does not reduce any longer mandatory right you may have under applicable law.

Do not return an item without following the authorization instructions in the Return Policy. Refunds are issued to the original payment method unless otherwise required by law or agreed with you.

11Safe Use of Mascot Costumes

Mascot costumes can reduce visibility, hearing, mobility, ventilation, and awareness of surrounding conditions. They are costumes, not personal protective equipment, safety equipment, or toys.

You are responsible for choosing an appropriate size and using each product safely. Users should:

  • inspect the costume before each use and stop using it if it is damaged;
  • maintain adequate ventilation, hydration, rest, and temperature control;
  • use a trained spotter or supervisor where visibility, crowds, stairs, traffic, heat, or the wearer’s age or condition makes supervision appropriate;
  • keep the costume away from open flames, high heat, moving machinery, road traffic, water hazards, and other unsafe environments; and
  • stop immediately if the wearer experiences overheating, breathing difficulty, dizziness, pain, restricted movement, or impaired vision.

Children must use costumes only under responsible adult supervision. Follow any product-specific care and safety instructions supplied with the item.

12Site Content and Intellectual Property

The Site and its original text, graphics, photographs, videos, software, page design, compilation, and other content are owned by or licensed to Wishmascot and are protected by intellectual property laws. Product or company names, logos, characters, and other materials belonging to third parties remain the property of their respective owners. Their appearance on the Site does not by itself imply sponsorship, endorsement, or affiliation.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for lawful personal or internal business shopping purposes. You may not copy, scrape, reproduce, distribute, sell, license, modify, create derivative works from, reverse engineer, or commercially exploit the Site or its content without our prior written permission, except where applicable law expressly permits it.

13Reviews, Feedback, and Other Submissions

If you submit a review, comment, photograph, suggestion, or other content to the Site (“User Content”), you retain any ownership rights you have in that content. You grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, reproduce, adapt, publish, display, and distribute the User Content as reasonably necessary to operate, improve, and promote Wishmascot and our products.

You represent that your User Content is accurate, reflects your genuine experience where applicable, and does not violate any law or third-party right. User Content must not contain unlawful, defamatory, deceptive, infringing, obscene, harassing, or malicious material, personal information posted without permission, or undisclosed advertising or incentives.

We may moderate, refuse, or remove User Content that violates these Terms or applicable law. We are not required to publish any submission. Personal information included in a submission is handled under our Privacy Policy.

14Copyright and Intellectual Property Complaints

If you believe content on the Site infringes your copyright, trademark, or other intellectual property right, email sale@wishmascot.com with:

  • your name and contact information;
  • identification of the protected work or right;
  • the URL or other clear identification of the material in question;
  • an explanation of why you believe the use is unauthorized; and
  • a statement that the information you provide is accurate and that you are the rights holder or authorized to act for the rights holder.

We may request additional information and may remove or restrict content while reviewing a complaint.

15Prohibited Uses

You may not use the Site to:

  • violate any applicable law or another person’s rights;
  • submit false, misleading, fraudulent, or unauthorized orders or payment information;
  • interfere with the Site’s security, operation, or other users;
  • introduce malware, harmful code, automated attacks, or excessive requests;
  • scrape, harvest, or collect data except as permitted by law and our written authorization;
  • impersonate another person or misrepresent your identity or affiliation; or
  • resell, exploit, or use Site content for an unauthorized commercial purpose.

16Third-Party Services and Links

The Site may link to or rely on services operated by third parties, such as payment processors, carriers, social media platforms, and other websites. Those services may have their own terms and privacy practices. We do not control and are not responsible for third-party content, availability, security, or practices. A link does not necessarily mean that we endorse the third party.

17Disclaimers

To the fullest extent permitted by law, the Site and its content are provided on an “as is” and “as available” basis. We do not guarantee that the Site will always be uninterrupted, secure, or error-free, or that all content will always be complete or current.

Products are subject to any express warranty stated on the product page or provided with the product and to rights that cannot lawfully be excluded. Except for those express warranties and mandatory rights, we disclaim implied warranties to the extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

18Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where applicable law prohibits such a limitation.

To the fullest extent permitted by law, Wishmascot and its affiliates, officers, employees, agents, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising from or related to the Site, a product, or these Terms, even if advised that such damage was possible.

To the fullest extent permitted by law, our total liability arising from or related to a product or order will not exceed the amount you paid us for the product or order giving rise to the claim. For claims relating only to use of the Site and not to an order, our total liability will not exceed USD $100.

Some jurisdictions do not allow certain warranty exclusions or liability limitations. In those jurisdictions, these provisions apply only to the extent permitted by law.

19Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Wishmascot and its affiliates, officers, employees, agents, contractors, and service providers from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Site, your material breach of these Terms, your User Content, or materials you provide for customization that infringe another person’s rights.

This section does not require you to indemnify any party for its own negligence, willful misconduct, or violation of law, and it does not limit non-waivable consumer rights.

20Privacy and Electronic Communications

Our Privacy Policy explains how we collect, use, and disclose personal information.

When you use the Site or contact us electronically, you consent to receive order, account, and service communications electronically. Marketing communications are optional where required by law, and you may unsubscribe using the instructions in the message.

21Events Outside Our Control

We are not responsible for delay or failure caused by events beyond our reasonable control, such as natural disasters, severe weather, epidemics, war, civil unrest, government action, labor disruption, carrier interruption, customs delay, power or internet outage, or supply-chain disruption. This section does not affect obligations that cannot be excluded by law. We will take reasonable steps to reduce the effect of such an event and keep affected customers informed where practicable.

22Changes to the Site and These Terms

We may update the Site and these Terms from time to time. The “Last updated” date shows when these Terms were most recently revised.

Changes apply prospectively when posted unless a later date is stated. The Terms in effect when an order is accepted will continue to govern that order unless a change is required by law or you agree otherwise. If a material change affects an existing account relationship, we will provide notice where required by law.

23Governing Law and Disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws principles, except that mandatory consumer protections in your place of residence remain applicable.

Before filing a formal claim, please contact us so we can try to resolve the issue. Subject to any mandatory right you may have to bring a claim elsewhere, the state and federal courts serving Arapahoe County, Colorado will have exclusive jurisdiction over disputes arising from or relating to these Terms, the Site, or an order.

24General Terms

If any provision of these Terms is found unenforceable, it will be modified only to the minimum extent necessary or severed, and the remaining provisions will continue in effect.

Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a merger, acquisition, corporate reorganization, sale of assets, or transfer of the Site or relevant business, subject to applicable law.

These Terms, together with the product page, order confirmation, Privacy Policy, Return Policy, Delivery Information, Customs & Import Tax Policy, and any other policy expressly incorporated here, form the entire agreement between you and us concerning the Site and your order. If policies conflict, the following order of priority applies: an individually agreed written term, the order confirmation, the product page, these Terms, and then the other Site policies.
